REDETERMINATION ELIGIBILITY REQUIREMENTS FOR CONSUMERS ELIGIBLE PRIOR TO AUGUST 9TH, 2003

Consumers having entered the regional center system prior to August 9th, 2003 will have the criteria used at the time of eligibility as the criteria for any reevaluation for continuing eligibility.

All regional center consumers who were determined eligible prior to August 9, 2003,   will continue to be eligible if they continue to meet two areas of substantial functional limitation under the old definition and continue to meet the definition of having a developmental disability.

If the regional center challenges a consumer’s eligibility through a process called redetermination, the criteria under which the consumer originally became eligible must apply according to AB 1762. 

Consumers must meet the following two areas of requirement to receive continuing eligibility.

First, consumers must meet the definition of developmental disability

“this term [developmental disability] shall include mental retardation, cerebral palsy, epilepsy, and autism.  This term shall also include disabling conditions found to be closely related to mental retardation or to require treatment similar to that required for individuals with mental retardation, but shall not include other handicapping conditions that are solely physical in nature.” W and I code, Div., 4.5, Chapter 1, Section 4512 (a).

 Second, consumers must meet two areas of substantial functional limitation.

 "Substantial disability" means the existence of significant functional limitations in two or more of the following areas of major life activity, as determined by a regional center, and as appropriate to the age of the person: 

  1. Self-care

  2. Communication skills

  3. Learning

  4. Mobility

  5. Self-direction

  6. Capacity for independent living

  7. Economic self-sufficiency
